Miramar wins civil case filed by company that sued for sewage and flooding issues

The city of Miramar was recently found not liable for nearly $200,000 in damages in a 2023 civil lawsuit filed by a property company, according to City Attorney Norman Powell.

Diversified RE Holdings LLC, a property owner in the El-Ad Residences community, sued the city over “extensive damages from water and sewage backups,” according to the complaint.

The Miramar News reached out to Diversified’s lawyers at Schilling & Silvers PLLC for comment on Oct. 21 but didn’t receive an immediate response.

Diversified said that on May 4, 2023, an expert report revealed mold on the property at 2201 W. Preserve Way, Unit 106, due to the water and sewage issues, court documents show.

In August 2023, Diversified said it had no choice but to gut the entire property and rebuild, the complaint said.

The complaint called out the City of Miramar’s potential negligence in maintaining water and sewage piping near residential areas and demanded $185,975 “to make Diversified financially whole,” the company’s lawyers wrote.

Now, nearly two and half years later, Powell announced at the Oct. 15 regular commission meeting that a jury found the city not liable for the damages on the property.

“The city was found not to be at fault or liable to the property owner,” he said.
