Man accused of killing ex in front of their kids in Miramar is sentenced to life
A man accused of fatally shooting his ex-girlfriend in front of their kids after a birthday party in Miramar four years ago has now been sentenced to life in prison.
A judge handed down the sentence Oct. 24, after a jury found 56-year-old Alfonso Dixon guilty of second-degree murder, a lesser offense than the one he was indicted on.
He went on trial in August on a first-degree murder charge in the shooting death of 37-year-old Ashley Davis.
“Mercy in this case is not warranted,” Judge Michael Rothschild said during the recent hearing, broadcast by NBC 6, as he sentenced Dixon to life.
Dixon’s defense attorney, Joseph Dewey, told the Miramar News on Oct. 27 that they’ve filed an appeal, in part hinging on evidence that they believe was improperly entered during the trial.
Dixon’s defense argued Dixon killed Davis in the “heat of passion” when he was trying to see his daughter on her birthday and instead encountered Davis with another man, thinking he and Davis were going to get back together.
“I regret what happened,” Dixon said in a pre-sentencing statement, according to his attorney. “There was no reason whatsoever to react the way I did. I don’t know what happened to me.”
Davis hosted her daughter’s birthday party at a friend’s house in Miramar on May 30, 2021, according to court documents. Once the party wrapped up, she went to say goodbye to her boyfriend and was walking toward her car in the driveway when witnesses said Dixon began chasing her with a gun, according to the Miramar Police Department and testimony from her boyfriend.
She ran away from Dixon, screaming, as he fired multiple shots at her in front of the kids, according to witnesses and Ring doorbell footage shown during the trial.
One of her kids reportedly said “my daddy trying to kill my mama,” testified Davis’ boyfriend, who witnessed the shooting and pulled his own gun in his girlfriend’s defense, according to court documents.
He told investigators Dixon was upset about the breakup with Davis and had been threatening her recently, police wrote in the arrest report.
Multiple 911 calls came in reporting the shots, according to police.
Dixon ran from the scene and told police he walked to his home in Miami Gardens from Miramar, the report shows. First responders said they found Davis with multiple gunshot wounds, and she died of her injuries.
Dixon’s defense filed motions for mistrial and to disqualify the judge, both of which were denied.
“He deserves to spend the rest of his life in jail for what he did to my niece,” Davis’ aunt Patricia Wagstaffe told NBC 6. “She didn’t deserve to be ran down and shot like some kind of animal.”
